I have prepared a short response to help inform you to alleviate any concerns this matter is under legal judicial review.


Concern: Inspection report appearing on the ISI website with an indication of failed points

The inspection report has now been released. We were informed that publication took place on 26 January, and since that date we have received a copy of the report. We are currently in the process of initiating a Judicial Review in relation to the inspection findings. This is because the four key areas cited as failures are, in our view, factually incorrect and unsupported by evidence.

Our evidence is date stamped, produced by a third party.

So I have had to act and take the steps for a legal case to protect this school.

Specifically:

We have appropriately trained Paediatric First Aiders with the correct qualification in place. – This is date stamped and was in place for the inspection.

All required Legionella works had been completed and reinspected providing proof work was completed.

We maintain a fully compliant electronic register, with records dating back to 2016. – They said we do not have fob boxes to electronically sign in, you know this is untrue.

No attendance incidents met the statutory reporting criteria; however, this information was not reviewed by the inspectors.

A full DBS check was in place for the volunteer mentioned in the report. They have a full DBS which was in p[lace before the inspection.

All of this evidence was presented to the inspection team during and after the inspection. Despite this, it has not been accepted, and no clear explanation has been provided for this decision.

We believe this may be linked to the fact that a formal complaint was raised during the inspection regarding the inspectors’ conduct. The conduct was sufficiently concerning that one pupil refused to return to school for the remainder of the term. Since raising this complaint, we have experienced repeated barriers to progressing it, leaving us with no alternative but to seek legal remedy. We are very disappointed with this treatment and have been fighting this since September, meeting closed doors, lies in the reports and accusations, alongside an un fair complaints process. I will not let this matter lie, and we will keep fighting it as they are wrong, and we have irrefutable proof from third party sources to corroborate all the evidence.

08/10/25 Stage 1 formal complaint submitted in writing in regard to inspector behaviour & failure to inspection of key aspects in the school, despite requests.

09/10/25 Phone Call in regard to inspector behaviour & failure to inspection of key aspects in the school, despite requests.

03/11/25 Email from ISI to say there will be a delay in response.

07/11/25 Dismissed complaint and issued draft report. Requested a fact check sheet for the report to be completed and sent back.

10/11/25 Completed fact check sheet and returned to ISI on the report. – adjustments were made to the report by the inspectors to corroborate their opinion – these were also incorrect and ignored the provided evidence.

19/11/25 Issued Stage 2 complaint to ISI in regard to inspector behaviour & failure to inspection of key aspects in the school.

02/12/25 Dismissed complaint and issued final draft of report. Further redactions and adjustments were made to the report by the inspectors to support their opinion – these were also incorrect, two were fictitious, and again they ignored the provided evidence.

02/12/25 Requested deferral from DfE on the publication of the report due to the large number of errors in the report and to request deferral until completed the independent review.

02/12/25 Issued Stage 3 complaint – independent review. Not independent as only the inspectors were contacted for their opinion.

19/01/25 Dismissed independent review. However, even more redactions and adjustments were made to the report but still they have ignored our supporting evidence.

26/01/25 Report published on ISI website.

03/02/25 Letter before Action Issued by STC to ISI for Judicial review.

The teaching a learning in the school was deemed excellent.

We have comprehensive documentation and evidence prepared for presentation to the Governing Body. In the interests of transparency and consistency, we would prefer to share this information with all relevant parties at the same time.
